1. Definitions

In these Terms, the following definitions apply:

• "Company" means Bangladesh Tour Guide, a company registered in the United Kingdom with company number 04815840.
• "Services" means any tour packages, guide services, transportation arrangements, accommodation bookings, or other travel-related services provided by the Company.
• "Website" means bangladeshtourguide.com and all its subdomains.
• "User" or "You" means any individual who accesses the Website or uses the Services.
• "Booking" means a confirmed reservation for any of our Services.
• "Deposit" means the initial payment required to secure a Booking.
• "Force Majeure" means any event beyond our reasonable control, including but not limited to natural disasters, political unrest, terrorism, strikes, and public health emergencies.

2. Website Use

2.1 Intellectual Property

The content on our Website, including text, graphics, logos, images, and software, is the property of the Company or its content suppliers and is protected by international copyright laws. You may view and download content for personal, non-commercial use only, provided you keep all copyright and proprietary notices intact.

2.2 Prohibited Uses

You agree not to use our Website:

• In any way that violates applicable laws or regulations
• To transmit or facilitate the transmission of unsolicited advertising or promotional materials
• To impersonate or attempt to impersonate the Company, a Company employee, or any other person
• To engage in any activity that could damage, disable, or impair the functioning of the Website
• To access data not intended for you or attempt to breach security measures

2.3 User-Generated Content

If you submit reviews, comments, or other content to our Website, you grant us a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, translate, and distribute such content worldwide in any media. You represent that you own all rights to the content you submit.

3. Bookings and Payments

3.1 Booking Process

To make a Booking, you must:

• Provide accurate and complete information as requested in our booking form
• Pay the required Deposit or full payment as specified at the time of booking
• Meet any additional requirements specified for particular Services (e.g., providing passport details for permit applications)

A Booking is not confirmed until you receive a written confirmation from us.

3.2 Payments

Payment terms:

• A non-refundable Deposit of 20-30% of the total tour cost is required to secure your Booking
• The remaining balance must be paid at least 30 days before the tour start date unless otherwise specified
• For Bookings made within 30 days of the tour start date, full payment is required at the time of booking
• All payments are in the currency specified at the time of booking

We accept credit/debit cards, PayPal, and bank transfers. Cash payments may be accepted in limited circumstances.

3.3 Pricing

All prices are subject to the following conditions:

• Prices are per person unless otherwise stated
• Prices are quoted in US Dollars (USD) unless otherwise specified
• We reserve the right to adjust prices due to currency fluctuations, government actions, or other factors beyond our control
• Any price adjustments will be communicated to you before your final payment is due

3.4 Special Requests

We will make reasonable efforts to accommodate special requests (such as dietary requirements or room preferences), but we cannot guarantee their fulfillment. Special requests should be made at the time of booking.

4. Cancellations and Changes

4.1 Cancellation by You

If you need to cancel your Booking, the following cancellation fees apply:

• 60+ days before tour start: Loss of Deposit
• 30-59 days before tour start: 50% of total tour cost
• 15-29 days before tour start: 75% of total tour cost
• 0-14 days before tour start or no-show: 100% of total tour cost

All cancellations must be made in writing to [email protected].

4.2 Changes by You

If you wish to make changes to your Booking:

• Changes requested more than 30 days before tour start may incur an administration fee of $50 USD
• Changes requested within 30 days of tour start are considered cancellations and rebookings, subject to availability and cancellation fees
• Name changes or transfers to another person may be permitted at our discretion and may incur a fee

4.3 Cancellation or Changes by Us

We reserve the right to cancel or modify a tour for reasons including:

• Insufficient participants to operate the tour
• Force Majeure events
• Safety concerns

In such cases, we will offer you the option of:

• Transferring to an alternative tour (price difference may apply)
• Receiving a credit for future travel
• Receiving a refund of amounts paid (excluding travel insurance premiums)

We are not responsible for any incidental expenses you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.

5. Responsibilities and Liabilities

5.1 Our Responsibilities

We agree to provide the Services as described in your Booking confirmation and to ensure that:

• Services are provided with reasonable skill and care
• All necessary licenses, permits, and authorizations are obtained
• Guides are qualified and experienced
• Reasonable assistance is provided in case of issues during your tour

5.2 Your Responsibilities

You are responsible for:

• Ensuring you have valid passports, visas, and travel insurance for your journey
• Obtaining any required vaccinations or health certificates
• Following all reasonable instructions from our guides and staff
• Respecting local customs, laws, and environmental regulations
• Behaving in a manner that does not disrupt the enjoyment of others
• Declaring any medical conditions that may affect your participation in tour activities

5.3 Limitation of Liability

Our liability is limited as follows:

• We are not liable for any injury, illness, death, loss, damage, expense, or other claim arising from:
  • Your own acts or omissions
  • Acts or omissions of third parties unconnected with the Services
  • Unusual or unforeseeable circumstances beyond our control
  • Events which neither we nor our suppliers could have anticipated or prevented
• Our maximum liability for any claim is limited to the total cost of your Booking
• We are not liable for services provided by third parties, though we will assist in resolving any issues

Nothing in these Terms limits our liability for death or personal injury caused by our negligence or fraudulent misrepresentation.

6. Insurance and Safety

6.1 Travel Insurance

Comprehensive travel insurance is mandatory for all clients and should include coverage for:

• Medical expenses and emergency repatriation
• Trip cancellation and interruption
• Personal liability
• Loss of luggage and personal effects

You must provide proof of insurance before the start of your tour. We reserve the right to refuse participation without adequate insurance.

6.2 Health and Safety

You must inform us of any medical conditions, disabilities, or special needs that may affect your participation in the tour. We will make reasonable efforts to accommodate special needs but reserve the right to decline bookings if we believe we cannot provide appropriate conditions.

You are responsible for assessing your fitness to participate in tour activities and following safety instructions provided by our guides.

7. General Provisions

7.1 Privacy

Our Privacy Policy governs the collection, use, and protection of your personal information. By agreeing to these Terms, you also consent to our Privacy Policy.

7.2 Governing Law

These Terms are governed by the laws of the United Kingdom. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

7.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7.4 Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our Website. Your continued use of our Services after changes are posted constitutes acceptance of the modified Terms.
